Acceptance of these terms and conditions

In the absence of specific written stipulations between the parties, all orders are automatically subject to the present terms and conditions of sale, which prevail over any other document, such as prospectuses, press releases, catalogs or e-mailings issued by the seller, which are for information purposes only.

Offers / Prices / Orders

All our wine offers are valid while stocks last, excluding promotions, special offers and gifts. Prices are given in Euros, all taxes included (excluding shipping costs). In view of the rare or speculative nature of certain products, we reserve the right to apply restrictions to the quantities available, or even to refuse or cancel an order that is manifestly abnormal.
Orders are not final until full payment has been received. Mundovin reserves the right to cancel any order from a wine professional. If the latter pays his order via his Paypal account, the transaction fees charged to the seller by Paypal will in no case be borne by Mundovin and will be deducted from the refund related to the cancellation of the order. Mundovin will not suffer any prejudice. Transaction fees are clearly stated on the Paypal website.

Prices

Prices are indicated in Euros (€). They include VAT but exclude shipping costs. Subject to typographical and display errors. Mundovin reserves the right to modify its prices and delivery charges at any time. However, products will be invoiced on the basis of the prices in force at the time of order registration, subject to availability. In the event of an internal error, Mundovin reserves the right to cancel the order and immediately reimburse the customer.

Minimum quantity

Certain references may be subject to minimum or maximum order quantities. This particular condition is clearly specified on the site for each of the references concerned.

Terms and conditions of payment

Payment for goods must be made in full when the order is placed, by credit/debit card such as Carte Bleue, Visa or Eurocard Mastercard.
When validating an order on the mundovin.com website, the customer is put in direct contact with our bank. The transmission of credit/debit card numbers is totally secure (SSL encryption) and ensured by Banque Populaire. 3D Secure authentication is necessary for Mundovin to validate the order. In the absence of 3D Secure authentication, Mundovin reserves the right not to finalize the order. In the event that payment has already been debited from the customer's bank account even though authentication has not taken place, Mundovin will contact the customer's bank. Any payment suspected of being fraudulent will not be reimbursed.
The customer guarantees that he/she is fully authorized to use the credit/debit card he/she is using and that this credit/debit card gives access to sufficient funds to cover the amount of the order. Mundovin reserves the right to cancel any non-compliant or dubious orders, as well as those from a member with whom there is a dispute relating to the payment of a previous order.

Product availability

As a general rule, all orders are honored. However, it is possible that an error may occur and a product may no longer be in stock after the order has been validated. In this case, Mundovin will inform the customer by e-mail or telephone of the partial or total cancellation of the order.
If the payment has already been debited from the customer's bank account, Mundovin will refund the order as soon as possible (within eight days) by re-crediting the credit/debit card used to pay for the order.
No postponement of the due date may be granted without our express prior consent.
An invoice will be issued by Mundovin and sent to the customer by e-mail.

Deliveries

Goods are insured by us during transport in metropolitan France and travel at our own risk. Deliveries are made within a maximum of 10 days from receipt of payment for the order. However, if 7 days after the deadline, and except in cases of force majeure, the goods have still not been delivered, the customer may cancel the contract by registered letter. The customer will obtain restitution of his payment, to the exclusion of any other indemnity or damages, within 14 days at the latest. Mundovin cannot be held responsible for the impossibility of delivering the goods to the right place at the right time in the event of errors in the information supplied by the customer. On receipt of the goods, it is the responsibility of the recipient to check the condition of the goods and to make any necessary observations in the event of breakage, damage or missing items, by expressing his reservations on the delivery note, and within 48 hours of receipt, by registered letter with acknowledgement of receipt to the carrier, with a copy to the seller, in order to preserve his rights. In the particular case where the customer has undertaken to collect the goods himself, and in the absence of collection within a maximum period of 2 months after the goods have been made available, Mundovin will be entitled to invoice additional storage costs, at the rate of 5 Euros (including VAT) per parcel and per month of delay.

Relay point deliveries

Deliveries to relay points may be subject to unforeseen circumstances if the relay point is closed. In this case, the parcel(s) will be delivered to the nearest open relay point to the one chosen by the customer. It is therefore the customer's responsibility to collect the parcel(s) within 7 days. In the event that the goods are returned to the sender, reshipment costs are increased by 5 euros per parcel, plus return costs equivalent to the increased redelivery costs.

Time limit for collecting parcels from relay points and conditions for reshipment

Packages not collected within 7 days from Chronopost points will be returned to the sender. Any reshipment will be subject to a surcharge of 5 euros per parcel in addition to the cost of the return, corresponding to the cost of shipping + 5 euros per parcel.

Right of withdrawal

Customers have 14 clear days from receipt of their order to exercise their right of withdrawal. The customer must first inform the sales department in writing (e-mail, letter) of his decision before returning the goods. A sample withdrawal form * is available below. As an exception, these provisions do not apply to orders for products that have been customized or specifically requested by the customer at the time of ordering (special formats, customized packaging, etc.). Should the products ordered be out of stock, Mundovin may, with the customer's agreement, offer to replace them with another vintage or an equivalent wine. Once the retraction has been transmitted, the customer has 14 days to return the unwanted products in their original packaging, for exchange or reimbursement, without penalty, with the exception of the cost of return, which remains at the customer's expense. However, the customer undertakes to ensure the return of the goods by the same carrier or equivalent, within the same timeframe and under the same transport conditions as for the initial delivery.
Mundovin reserves the right to defer reimbursement until recovery of the goods in their entirety and in perfect condition.

Conditions of withdrawal

Any order may be retracted provided that the parcel(s) making up the order are returned intact to the seller within 14 days of the customer's wish to retract being sent. The return costs will be borne by the purchaser and correspond to the amount of the shipping costs + 5 euros per parcel. If the customer has not been able to receive the parcel within the time limit and the parcel is returned to Mundovin, the buyer must pay the return and reshipment costs if he/she wishes to be re-delivered.

Reservation of ownership clause

In accordance with the law of May 1, 1980, products delivered to the customer are sold under reservation of title. Transfer of ownership is subject to full payment of the product price by the customer, on the due date agreed between the parties. However, the purchaser becomes responsible for the articles as soon as they are delivered, and the transfer of possession is equivalent to the transfer of risk.
In the event of non-payment of the total price of the goods by the agreed due date, Mundovin may claim ownership of the products at the customer's expense and risk.

Applicable law and jurisdiction

In the event of difficulties in applying the present terms and conditions of sale, we invite you to seek an amicable solution by contacting our customer service department. These general terms and conditions of sale are governed by French law, in application of the Rome 1 regulation.

Protection of minors

In accordance with article L. 3342-1 of the French Public Health Code, the purchaser undertakes to be at least 18 years of age on the date of the order.

Alcohol abuse

Alcohol abuse is dangerous for your health. Please consume and enjoy in moderation.
